Funder background / Names in the records

The Everest file

Everest describes its business as providing revenue-based financing. When you review an Everest MCA, look beyond the brand name: public records also use EBF company names.

Florida’s Division of Corporations lists Everest Business Funding, LLC with the cross-reference name EBF Holdings, LLC. Separately, a December 2023 New York court decision identifies EBF Partners, LLC d/b/a Everest Business Funding as the plaintiff.

Those records help identify names; they do not establish which company holds or can enforce your particular agreement. Compare your signed contract with any assignment, MCA UCC filing, collection notice, or complaint. A name difference calls for reviewing the supporting records, not assuming the companies are interchangeable.

Start with your situation

What is happening with your Everest MCA?

The next step depends on whether you are struggling with payments, receiving demands, or responding to court papers.

01 / PAYMENTS

Payments are becoming unaffordable

Review the payment structure, reconciliation provisions, and other MCA obligations. Discuss whether a payment adjustment, negotiation, or settlement is worth pursuing.

02 / COLLECTION

Collection is disrupting the business

Gather default notices, MCA UCC filings, and communications sent to your customers or payment processor. The agreement and the actual demand need to be reviewed together.

03 / LAWSUIT

You have received court papers

Identify the court, parties, service details, and response deadline promptly. A review can address the amount claimed, personal guarantees, and potential defenses.

Before the next call or deadline

Four practical first steps.

  1. Check for a court deadline. If you received court papers, identify where the case is filed and when a response is due. Settlement discussions do not automatically extend a deadline.
  2. Put the records in one place.Collect the agreement, payment history, bank statements, and every notice. Preserve emails and texts, including any proposed settlement terms.
  3. Review a proposed change before signing.A new agreement, acknowledgment, release, or guarantee can affect your rights and obligations. Have its terms reviewed in context.
  4. Discuss a plan for your actual situation.Ask which legal or negotiation options fit the documents, cash flow, and litigation status—and what representation would cost.
Questions business owners ask

Everest MCA questions, answered.

Can I ask for help before missing a payment?

Yes. You can request a free review while payments are current. Bring your agreement, payment schedule, and cash-flow information so the attorney can assess the pressure on the business and discuss possible next steps.

Does an Everest MCA lawsuit mean I owe the full amount claimed?

A claim is an allegation. Whether the amount is recoverable depends on the agreement, payment records, applicable law, and procedural history. Responding on time matters; an attorney can review the claim and any available defenses.

Can a personal guarantee put me at risk?

Potentially. The wording of the guarantee, the conduct alleged, and applicable law matter. Do not assume that an MCA obligation is either automatically personal or limited to the business.

Can an Everest balance be settled for less?

A negotiated resolution may be possible, but no particular reduction or payment arrangement can be promised. The example above is a conditional offer from one matter, not a prediction for another business.

Is the MCA review free?

Yes. Consultations and the initial MCA review or case evaluation are free. If you retain the firm, legal-service fees are separate and will be addressed in the engagement terms.
