Kansas has a commercial financing disclosure law

The Kansas Commercial Financing Disclosure Act (K.S.A. 75-783 to 75-787), effective July 1, 2024, generally requires covered providers to give cost disclosures for commercial financing of $500,000 or less, including accounts receivable purchase transactions that can cover many MCAs. The Attorney General enforces it. Whether it applies, and what it means in a particular dispute, depends on the transaction.

Kansas MCA UCC records can help reconstruct a renewal

The Kansas Secretary of State publishes UCC filing information, search options and forms for financing statements and amendments. Gather the initial record and any changes linked to the MCA. Compare secured-party names, collateral descriptions and document dates with the renewal and payoff papers. A newer filing does not, by itself, show whether an earlier MCA balance was paid or its related obligations released.

Calculate the net benefit of a proposed refinance

Place the proposed advance beside the existing obligations: gross funding, fees, prior payoff, net deposit and new daily or weekly withdrawals. Include any balance that would remain with another funder. This record supports a realistic comparison with potential settlement or restructuring. Check the court named in the papers

If your Kansas business receives MCA court papers, check the court where the case was filed, each named defendant, and how and when the papers were served. The agreement’s forum and governing-law provisions also need review.

The deadline depends on the court, service, and applicable procedure. Do not assume your business’s home-state rules control a case filed elsewhere. Have the summons, complaint, and service details reviewed promptly.

Are confessions of judgment enforceable in Kansas?+
Kansas voids confession-of-judgment authorizations in consumer credit transactions (K.S.A. 16a-3-306), but that statute generally does not cover business obligations, and Kansas law for commercial agreements is less settled. An MCA funder may try to obtain a confessed judgment in another state, such as New York, and then enforce it in Kansas, so the agreement's choice-of-law or forum clause may matter. Prompt review is generally advisable.
How long do I have to respond to an MCA lawsuit in Kansas?+
In Kansas district court, a defendant generally must serve an answer within 21 days after being served with the summons and petition under K.S.A. 60-212(a). Deadlines can differ, for example in federal court, after service by publication, or if the funder sued in another state, such as New York. Check the summons for the stated deadline and act promptly, because missing it may lead to a default.
