Florida has its own rules that can matter in an MCA dispute. The Florida Commercial Financing Disclosure Law (Fla. Stat. §§ 559.961–559.9615) requires providers to give written disclosures for many commercial financing transactions consummated on or after January 1, 2024. Separately, Fla. Stat. § 55.05 treats powers of attorney to confess judgment signed before a lawsuit as void. Whether either applies to your agreement depends on its terms, date, amount and governing-law clause, so the documents need review.
