Check the court named in the papers

If your Maryland business receives MCA court papers, check the court where the case was filed, each named defendant, and how and when the papers were served. The agreement’s forum and governing-law provisions also need review.

The deadline depends on the court, service, and applicable procedure. Do not assume your business’s home-state rules control a case filed elsewhere. Have the summons, complaint, and service details reviewed promptly.

How long do I have to respond to an MCA lawsuit in Maryland?+
Generally, a defendant served within Maryland has 30 days after service to answer a complaint under Maryland Rule 2-321(a), and a defendant served outside Maryland but within the U.S. generally has 60 days. Deadlines can differ in federal court or in a case filed in another state, such as New York under an MCA forum clause, so check the summons or notice carefully and act promptly.
