Understand MCA UCC issuesThe New Mexico Secretary of State directs UCC filings to its online portal and provides filing guidance. For an MCA review, retain the filing confirmation and the actual record, including any later amendment or termination. Identify the company and secured party named in each document. Those records help explain a claimed collateral interest but do not replace the agreement or establish the correct payoff balance on their own.
Request a complete copy of what was signed, including schedules, guarantees and electronic-signature records when available. Save offer emails and any change to the withdrawal amount. A screenshot of the first page may omit the provisions that control reconciliation, forum selection or fees. If litigation has started, collect those documents while ensuring the court deadline receives immediate attention.

If your New Mexico business receives MCA court papers, check the court where the case was filed, each named defendant, and how and when the papers were served. The agreement’s forum and governing-law provisions also need review.
The deadline depends on the court, service, and applicable procedure. Do not assume your business’s home-state rules control a case filed elsewhere. Have the summons, complaint, and service details reviewed promptly.
