The Samson MCA file
Samson MCA LLC is the plaintiff in the redacted stipulation in BDLG’s document library. The heading refers to leave to apply for a default judgment under New York CPLR 3215(i). That makes the court consequences an essential part of reviewing the proposed payments.
This guide concerns Samson MCA LLC. Searches for Samson Funding or Samson Group do not by themselves establish the identity of the contracting party. Compare the signed agreement, complaint and proposed stipulation instead of assuming similarly named businesses are interchangeable.
A separate 2024 New York decision, Samson MCA LLC v. Hudson’s Edge Catering & Events LLC, examined the particular agreement’s reconciliation, term and business-risk provisions when rejecting counterclaims. It does not resolve every Samson dispute. The text and operation of your agreement, as well as the stage of your case, still need individual review.

A Samson MCA stipulation requiring an upfront payment.
The published record compares $26,000 in conditional settlement terms with $37,564.38 in unpaid receivables and stated fees. It calls for $15,000 initially, followed by five $2,200 payments. The excerpt also includes consent language and a default-judgment reference; meeting the payment terms is not the only point to understand.

Review the judgment provision before committing to the schedule.
CPLR 3215(i) addresses a particular route to judgment when a qualifying settlement stipulation in an action provides for judgment after failure to comply. It is not the same procedure as a confession of judgment. Whether a clause satisfies the rule and what amount or notice is required must be assessed from the complete stipulation and case record.
Identify any admission, consent to jurisdiction, acceptance of service or waiver in the proposal. Ask counsel what takes effect at signing and what depends on payment. The effect of those clauses cannot be assessed from a reduced settlement number alone.
Then test the initial $15,000 requirement and later installments against available cash. For your proposal, confirm the due dates, permitted method, final amount and treatment of late or returned payments. Keep proof of performance and obtain the agreed closing documents rather than assuming the case ends automatically with the first payment.
Where does your Samson MCA matter stand?
MCA payments are too much
Evaluate the upfront payment separately from later installments and identify the source of funds for both.
Receivables or accounts are affected
Check whether any MCA UCC or receivables restriction is covered by the stipulation and when a release would take effect.
Court papers have arrived
Review the proposed consent and default-judgment provisions with the existing case record before signing.
Four practical first steps.
- Check for a court deadline. If you received court papers, identify where the case is filed and when a response is due. Settlement discussions do not automatically extend a deadline.
- Put the records in one place.Collect the agreement, payment history, bank statements, and every notice. Preserve emails and texts, including any proposed settlement terms.
- Review a proposed change before signing.A new agreement, acknowledgment, release, or guarantee can affect your rights and obligations. Have its terms reviewed in context.
- Discuss a plan for your actual situation.Ask which legal or negotiation options fit the documents, cash flow, and litigation status—and what representation would cost.
Samson MCA questions, answered.
Is a stipulation referring to CPLR 3215(i) a confession of judgment?
They are different procedures. The cited subsection concerns qualifying settlement stipulations in an action. Counsel should review the actual clause, court record and requirements before explaining its effect in your matter.
Does the Hudson’s Edge decision mean every Samson agreement is enforceable?
No. It addressed the particular contract and counterclaims presented there. It is not a substitute for reviewing your agreement, performance and available defenses.
What does consent to service or jurisdiction change?
Such terms may affect objections or procedural rights in the case. Their scope depends on the wording and circumstances, so review them with counsel before signing.
Can I obtain help if I am struggling before signing a stipulation?
Yes. Bring the proposal, agreement, payment history and court papers. Review can address whether the proposed schedule and legal terms fit the business’s circumstances.
What does the free MCA review cover?
