The Ace Funding file
Our document library includes a settlement naming ACE Funding Source LLC. Its heading refers to a stipulation permitting an application for default judgment under New York CPLR 3215(i). The text also contains consent to jurisdiction and acceptance of service.
Those provisions explain why a settlement needs a legal review even when its payments look manageable. This guide concerns MCA obligations involving the named entity. Match the exact company in your papers rather than assuming that every business using “Ace” is the same funder.

An Ace example combines a payment plan with court terms.
The excerpt states a $29,559 balance and provides for $9,000 in conditional settlement payments: $3,000 initially, then $1,000 each month until the settlement balance is paid. The full document controls deadlines, default consequences and releases; this excerpt is not proof of payment completion.

Partial, redacted excerpt from one matter. Other pages, amendments and later events may affect these terms. This discussion does not summarize the complete agreement or case. Acceptance, completed payment, releases and the final outcome require verification from the complete records. This is not a standard offer or promised result. Past results do not guarantee a similar outcome.
A reduced balance does not remove every litigation question.
Check whether a lawsuit has already been commenced and which defendants are signing. The visible example includes consent to jurisdiction and acceptance of service. Ask how the agreement changes any objections or defenses and whether it resolves both the business and guarantor obligations.
CPLR 3215(i) addresses entry of judgment after noncompliance with a qualifying settlement made after an action begins. It is a specific procedure with requirements, not a statement that every missed MCA payment automatically creates a judgment. Have the stipulation’s judgment amount, notice language and credited payments reviewed.
Keep the original contract with the settlement. An arbitration clause, amendment, waiver or release can affect the available path. Do not assume that discussing payments with a collector pauses a court deadline or that a new payment arrangement preserves every right in the original agreement.
Where does your Ace Funding matter stand?
MCA payments are too much
Compare Ace’s initial payment and monthly installments with the business’s other MCA withdrawals before committing.
Receivables or accounts are affected
Collect any processor notices and ask when release instructions would be issued under the complete settlement.
Court papers have arrived
Have counsel review the summons, service history and any proposed consent or default-judgment provisions together.
Four practical first steps.
- Check for a court deadline. If you received court papers, identify where the case is filed and when a response is due. Settlement discussions do not automatically extend a deadline.
- Put the records in one place.Collect the agreement, payment history, bank statements, and every notice. Preserve emails and texts, including any proposed settlement terms.
- Review a proposed change before signing.A new agreement, acknowledgment, release, or guarantee can affect your rights and obligations. Have its terms reviewed in context.
- Discuss a plan for your actual situation.Ask which legal or negotiation options fit the documents, cash flow, and litigation status—and what representation would cost.
Ace Funding MCA questions, answered.
Does a $9,000 example mean Ace will accept that amount in my case?
No. It records terms in one matter with its own balance and conditions. It is not an available offer, standard discount or prediction for another account.
What should I check before consenting to service?
Ask what papers you are acknowledging, which defendants are covered and what effect the consent may have on the case. Do that review before signing, rather than treating the language as a payment-processing detail.
Is this the same as a confession of judgment?
The example identifies a settlement procedure under CPLR 3215(i), which concerns qualifying stipulations after an action begins. Do not substitute general statements about confessions of judgment for a review of this separate procedure.
Can I seek help before signing an Ace settlement?
Yes. A review can address the proposed schedule, court language and releases before you commit. You do not need to wait for a settlement default.
What does the free MCA review cover?
The initial consultation can address your MCA agreement, payment pressure, collection communications or case status. Consultations are free. Any retained legal-service fees are separate and addressed in the engagement terms.
