Advance Service Group MCA lawsuit against your business and you?
An Advance Service Group lawsuit may name both a business and an individual guarantor. Read each person's position separately before assuming that one defense, judgment or settlement resolves the entire matter.

The ASG file
The public settlement excerpt in BDLG's library names Advance Service Group, LLC as purchaser and plaintiff. It describes a receivables purchase agreement, a seller and a guarantor, and a settlement after litigation began. Those separate capacities matter when checking who owes what and who receives a release.
A 2021 Kings County decision, Advance Services Group LLC v. Round Table Enterprises, illustrates the need for separate review. The court left the business's default judgment in place but vacated the guarantor's judgment and dismissed the complaint against him. It considered an additional-notice defect and problems with the named plaintiff. The court rejected the challenge to the contractually permitted email service of the summons and complaint.
That decision concerns a different matter from the redacted BDLG example. It is not a finding that all ASG agreements are invalid or that every guarantor has the same defense. Bring the exact contract names, service records and docket in your case.

Partial, redacted excerpt from one matter. Other pages, amendments and later events may affect these terms. This discussion does not summarize the complete agreement or case. Acceptance, completed payment, releases and the final outcome require verification from the complete records. This is not a standard offer or promised result. Past results do not guarantee a similar outcome.
Separate the party, the notice and the balance
Make one file for the business's papers and another for each guarantor's papers. Compare the names in the complaint, guaranty, service affidavits and proposed release. A document that settles the merchant's obligation may require closer reading before you can tell whether it also resolves an individual's exposure.
Preserve email headers and attachments as well as envelopes and mailing records. A complaint, an additional default notice and an enforcement notice serve different purposes. The Round Table decision shows why a general statement that you were never personally handed papers may not answer every service question. Counsel must assess the actual method and applicable requirements.
For a settlement like the public example, ask for a breakdown of receivables, claimed fees, costs and credits. Then assess the initial payment separately from the monthly commitment. Check what happens if funds arrive after the stated receipt deadline, whether any cure period exists and which closing documents follow full performance.
Where does your ASG matter stand?
MCA payments are too much
An affordable monthly figure does not solve an unaffordable initial payment. Review both against existing MCA withdrawals and operating expenses.
Receivables or accounts are affected
Identify which judgment debtor and account a restraint concerns. Preserve the bank's complete notice and any claimed exemption or response instructions.
Court papers have arrived
Bring papers for every named defendant. A business and its guarantor may have different procedural issues even within the same case.
Four practical first steps.
- Check for a court deadline. If you received court papers, identify where the case is filed and when a response is due. Settlement discussions do not automatically extend a deadline.
- Put the records in one place.Collect the agreement, payment history, bank statements, and every notice. Preserve emails and texts, including any proposed settlement terms.
- Review a proposed change before signing.A new agreement, acknowledgment, release, or guarantee can affect your rights and obligations. Have its terms reviewed in context.
- Discuss a plan for your actual situation.Ask which legal or negotiation options fit the documents, cash flow, and litigation status—and what representation would cost.
ASG MCA questions, answered.
Does a defense for the guarantor automatically protect the business?
No. The court can reach different results for different defendants. Review the claims and procedural history for each party rather than treating the business and owner as interchangeable.
Does a slightly different plaintiff name automatically end the case?
No. The significance of a naming discrepancy depends on the entities, contract, pleadings, evidence and procedural rules. Preserve the discrepancy for counsel's review; do not ignore a deadline because of it.
Is $81,725.52 the original amount advanced?
The excerpt identifies it as a balance including attorneys' fees and costs. It does not identify that figure as the cash originally received by the merchant.
Can I use the payment schedule shown here?
It records terms in one matter. Availability of any new arrangement depends on your account, documents, circumstances and the other party's agreement.
