Celtic Advance MCA lawsuit or a settlement with several payment stages?

Business Debt Law Group / MCA funder guide

A Celtic Advance matter can require two separate reviews: what the original agreement actually does, and what a new settlement would require. Neither question is answered by the label on the first page.

The Celtic file

The BDLG settlement excerpt names Celtic Advance LLC. Separate public court records also identify Celtic as a party to merchant cash advance agreements. The contract version, amendments and payment history in your own matter remain essential.

In a June 18, 2026 opinion in the Crosby bankruptcy litigation, the Eastern District of Louisiana bankruptcy court characterized the two Celtic agreements before it as loans under New York law for the issues decided there. The court examined the allocation of receivables risk and the agreements’ combined provisions. It granted part of the requested relief and denied part; the ruling is not a blanket cancellation of all Celtic obligations.

That court matter is separate from BDLG’s redacted settlement example. A lawyer must assess whether the decision is relevant to your agreement and current procedural posture, including any later case developments. Do not stop payments or ignore court papers based solely on another business’s ruling.

Acceptance, completed payment, releases and the final outcome require verification from the complete records. This is not a standard offer or promised result. Contract substance / Payment stages

Review the entire obligation, not just the recurring payment

An initial wire, a recurring installment and a final payment have different cash-flow effects. Make a dated schedule from the complete agreement, including the last installment and any holiday adjustment. Confirm how partial credits or early payments affect each component rather than assuming they reduce every later debit automatically.

Keep the original agreement analysis separate from the settlement analysis. Potential arguments about the original transaction may be affected by admissions, waivers or releases in a later stipulation. Have those provisions reviewed before relying on a decision involving another contract.

The reference to default judgment makes later pages particularly important. Identify notice requirements, any opportunity to cure, the calculation sought after a missed payment and the court procedure contemplated. A summary of page one cannot establish those terms or whether the settlement was performed.

Before the next call or deadline

Four practical first steps.

  1. Check for a court deadline. If you received court papers, identify where the case is filed and when a response is due. Settlement discussions do not automatically extend a deadline.
  2. Put the records in one place.Collect the agreement, payment history, bank statements, and every notice. Preserve emails and texts, including any proposed settlement terms.
  3. Review a proposed change before signing.A new agreement, acknowledgment, release, or guarantee can affect your rights and obligations. Have its terms reviewed in context.
  4. Discuss a plan for your actual situation.Ask which legal or negotiation options fit the documents, cash flow, and litigation status—and what representation would cost.
Questions about this funder

Celtic MCA questions, answered.

Did the Crosby ruling invalidate every Celtic MCA?

No. It addressed the agreements and issues before that court. Your documents, facts, applicable law and procedural history require separate review.

Is the monthly installment the entire payment commitment?

Not in the public example. It includes initial, recurring and separate final components. Review the full schedule.

Does the excerpt prove a default judgment was entered under the settlement?

No. A reference to a procedure does not establish that it was used. The docket and complete records are needed.

Should I change payments based on a published case?

Get advice on your own agreement first. A ruling involving another business does not by itself change your payment obligations or deadlines.

What does the free MCA review cover?

The initial consultation can address your MCA agreement, payment pressure, collection communications or case status. Consultations are free. Any retained legal-service fees are separate and addressed in the engagement terms.
