The Katan file

The public document in BDLG’s library identifies Katan Capital LLC. Its opening pages separate principal from attorney and filing charges, then discuss a lump-sum settlement and funds that may be held elsewhere. Those are different accounting questions, even when they appear in the same stipulation.

The excerpt includes pages from a longer agreement. Its provisions about consent, service and claims should be reviewed with the remaining pages and case docket before anyone relies on a dollar figure alone.

This guide focuses on a practical issue raised by this Katan excerpt: whether funds discovered after a proposal would reduce what remains to be paid. It does not establish Katan’s standard terms or the outcome of this matter.

A $6,500 proposal with a separate held-funds clause

Listed components $13,396.05 / proposed lump sum $6,500

The visible components total $13,396.05, before the additional interest and other amounts referenced in the excerpt. The proposal states a $6,500 lump sum. It also addresses previously undisclosed funds: the parties would discuss allocation in good faith, and an agreed allocation to the plaintiff would be deducted from the remaining settlement balance. That is not the same as saying every frozen dollar automatically receives credit.

Acceptance, completed payment, releases and the final outcome require verification from the complete records. This is not a standard offer or promised result. Held funds / Written allocation

Find out whose money is counted in the settlement

Build two lists: money you would send directly and money already held by a processor, customer or other payor. Identify the holder, amount, reason for the hold and any competing demand. A settlement figure can be misleading if the same funds appear in both lists.

Ask how newly discovered funds would be handled, who must agree to their allocation and when a credit would post. The Katan excerpt refers to a discussion and agreed allocation; it does not support assuming an automatic credit before those conditions are met. Put any clarification in the signed agreement or an authorized written amendment.

Review what happens if a holder cannot release the funds on time. Your payment obligation, the holder’s process and a court deadline can run on different schedules. Preserve release requests and acknowledgments, and have counsel check the complete stipulation’s default provisions.

Before the next call or deadline

Four practical first steps.

  1. Check for a court deadline. If you received court papers, identify where the case is filed and when a response is due. Settlement discussions do not automatically extend a deadline.
  2. Put the records in one place.Collect the agreement, payment history, bank statements, and every notice. Preserve emails and texts, including any proposed settlement terms.
  3. Review a proposed change before signing.A new agreement, acknowledgment, release, or guarantee can affect your rights and obligations. Have its terms reviewed in context.
  4. Discuss a plan for your actual situation.Ask which legal or negotiation options fit the documents, cash flow, and litigation status—and what representation would cost.
Questions about this funder

Katan MCA questions, answered.

Does Katan’s $6,500 example include all held funds?

The excerpt has a separate allocation provision. The complete agreement and any later written allocation are needed to answer that.

Will a newly discovered hold automatically reduce my payment?

Do not assume so. This excerpt describes discussion and an agreed allocation before the stated credit applies.

Is $13,396.05 the final amount owed in this matter?

It is the sum of the listed components, not a verified payoff. Additional interest and other amounts are referenced.

Can I use these terms for my Katan account?

They are one partial example, not an offer to another business. Your agreement, account history and negotiations control.

What does the free MCA review cover?
