The Kodiak file
The published excerpt identifies Kodiak Funding LLC and refers to a judgment principal amount of $16,883.17, with interest and expenses addressed separately. Its $10,000 settlement figure is divided among received funds, a conditional release and additional scheduled payments.
A separate 2022 New York decision, Kodiak Funding, LLC v. Golden Hospitality LLC, granted Kodiak summary judgment after reviewing the agreement, funding proof and remittance records. The court also considered a short payment hold and the agreement’s written-modification terms. That ruling concerned its own evidence and contract; it does not decide another merchant’s defenses.
The court decision and BDLG’s redacted excerpt are separate records. Keep your own account ledger, any payment accommodation and the actual litigation documents together so counsel can evaluate the evidence relevant to your matter.

Three funding sources within one $10,000 figure
The excerpt identifies $800.25 as already received, $3,345.97 to be obtained through a conditional release and $5,853.78 in additional scheduled payments. Those figures total $10,000, but only the first is described as received. The conditions, transfer records and complete agreement are necessary to verify what actually reached the creditor and what remained outstanding.

Partial, redacted excerpt from one matter. Other pages, amendments and later events may affect these terms. This discussion does not summarize the complete agreement or case. Acceptance, completed payment, releases and the final outcome require verification from the complete records. This is not a standard offer or promised result. Past results do not guarantee a similar outcome.
Keep pending funds out of the received column
Use a ledger with separate columns for received, pending release and still due. Record the date, source and confirmation for each transfer. A processor’s acknowledgment that it received a release request does not establish that the creditor received the money.
Check who must sign a conditional release and what efforts are required to secure the transfer. If money is delayed or a holder identifies another claim, review the agreement before assuming your scheduled payments change automatically. Request a written reconciliation of the amounts actually credited.
Preserve any promise to pause debits or allow time to resolve banking problems. The Golden Hospitality decision illustrates why an informal accommodation should not be treated as a complete waiver of contractual rights. Its particular result is not a prediction for your case; the wording and evidence must be assessed individually.
Where does your Kodiak matter stand?
MCA payments are too much
Compare the next scheduled payment with actual credits, rather than treating pending money as already paid.
Receivables or accounts are affected
Gather the conditional release, the holder’s response and proof of the eventual transfer.
Court papers have arrived
Identify whether you face a complaint, a motion or enforcement of an existing judgment; each requires its own review.
Four practical first steps.
- Check for a court deadline. If you received court papers, identify where the case is filed and when a response is due. Settlement discussions do not automatically extend a deadline.
- Put the records in one place.Collect the agreement, payment history, bank statements, and every notice. Preserve emails and texts, including any proposed settlement terms.
- Review a proposed change before signing.A new agreement, acknowledgment, release, or guarantee can affect your rights and obligations. Have its terms reviewed in context.
- Discuss a plan for your actual situation.Ask which legal or negotiation options fit the documents, cash flow, and litigation status—and what representation would cost.
Kodiak MCA questions, answered.
Was all $10,000 already paid in the example?
The excerpt does not establish that. It describes one received amount and other amounts subject to release or future payments.
Does a conditional release mean the money has arrived?
No. Verify execution, transfer and the creditor’s posted credit separately.
Does an email payment hold stop the lawsuit?
Do not assume it does. Review exactly what was agreed, the signer’s authority and the court deadlines.
Does the Golden Hospitality ruling decide every Kodiak case?
No. It was a ruling on a particular agreement and evidentiary record, not a determination of your matter.
