The statutory definition can include a fixed payment with a reconciliation process that adjusts to sales or revenue. The related regulations specify a disclosure form. Bring the original disclosure, agreement and records of any request to adjust payments. Show the revenue figures submitted, the funder’s response and the actual debits before and after the request. These facts can help counsel evaluate how the arrangement operated and what legal or negotiated options may be available when revenue has changed.

If your Virginia business receives MCA court papers, check the court where the case was filed, each named defendant, and how and when the papers were served. The agreement’s forum and governing-law provisions also need review.
