Check the court named in the papers

Are confessions of judgment enforceable in Arkansas?+

Even so, an MCA funder may try to obtain a confessed judgment in another state, such as New York, and then seek to enforce it in Arkansas. The agreement's New York choice-of-law or forum clause may matter, so have any confession clause reviewed promptly.
How long do I have to respond to an MCA lawsuit in Arkansas?+
In Arkansas state circuit court, a defendant generally must file an answer within 30 days after being served with the summons and complaint under Ark. R. Civ. P. 12(a). Deadlines can differ, for example in federal court or if the funder sued in another state, such as New York. Check the summons for the stated deadline and act promptly, because missing it may lead to a default judgment.
