Understand MCA UCC issuesWashington’s Department of Licensing provides online UCC filing and search services, including searches when the filing number is unknown or the secured party’s name is available. Its guidance distinguishes free search results from document copies that may carry a fee. Use the relevant financing records alongside the notice affecting the business; a Secretary of State business-entity lookup serves a different purpose.
Request the written reason funds are unavailable, the party that requested the action and any order or notice relied on. Record which account or receivables are affected and when the restriction began. Counsel can assess urgency and potential relief. An attorney review does not itself release funds or prevent a scheduled withdrawal.
For more information, read our guide to MCA restructuring options. A merchant cash advance attorney can review how the issues relate to your agreements and circumstances.
If your Washington business receives MCA court papers, check the court where the case was filed, each named defendant, and how and when the papers were served. The agreement’s forum and governing-law provisions also need review.
The deadline depends on the court, service, and applicable procedure. Do not assume your business’s home-state rules control a case filed elsewhere. Have the summons, complaint, and service details reviewed promptly.
Already received court papers? Tell the attorney when you contact us. Requesting a review or negotiating with a funder does not itself extend a court deadline or stop collection activity.
"Understanding why receipts are unavailable is the first step toward evaluating an appropriate response."
