All Shore Capital MCA lawsuit or a settlement stipulation to review?

A lower payment total does not answer what happens to a pending lawsuit. Review the stipulation’s court provisions alongside its payment schedule.

The All Shore file

The public excerpt identifies All Shore Capital LLC and describes $29,745.78 in unpaid receivables, together with additional fees and costs. It sets out $15,000 in settlement terms.

Its heading refers to a stipulation of settlement and leave to apply for a default judgment under CPLR 3215(i). The visible terms also address service, jurisdiction and monthly payments by the fifth. The installment amount and starting date are redacted.

This is a partial record from one matter. It does not establish that every All Shore agreement uses the same procedure, that a judgment was entered, or that the settlement was completed. Match the legal party and case number to your own documents.

A reduced total with a separate court-enforcement question

Unpaid receivables stated $29,745.78 plus additional items / settlement terms $15,000

The excerpt states a $15,000 settlement amount and a monthly due date, but redacts the starting date and installment amount. Its heading references an application for default judgment and its opening terms include consent and service provisions. The complete stipulation and docket are needed to determine the full default mechanism, any notice or cure terms, and what was actually signed or filed.

Settlement stipulation / Court procedure

Check the litigation consequences before signing the payment plan

New York CPLR 3215(i) addresses qualifying settlement stipulations made after an action begins that provide for judgment without further notice if their terms are not met. It is not a statement that every settlement automatically becomes a judgment. Counsel should review the actual language, required proof and procedural circumstances.

Ask what the proposed document does to any pending response, motion or enforcement activity. Confirm the payment dates and what counts as timely receipt. A lower settlement total alone does not establish that the case has been dismissed or all enforcement paused.

Keep the signed version and court record with each payment confirmation. At completion, check the specific dismissal, satisfaction or release steps required in your matter. Do not use the redacted dates in this example to calculate your own obligations.

Before the next call or deadline

Four practical first steps.

  1. Check for a court deadline. If you received court papers, identify where the case is filed and when a response is due. Settlement discussions do not automatically extend a deadline.
  2. Put the records in one place.Collect the agreement, payment history, bank statements, and every notice. Preserve emails and texts, including any proposed settlement terms.
  3. Review a proposed change before signing.A new agreement, acknowledgment, release, or guarantee can affect your rights and obligations. Have its terms reviewed in context.
  4. Discuss a plan for your actual situation.Ask which legal or negotiation options fit the documents, cash flow, and litigation status—and what representation would cost.
Questions about this funder

All Shore MCA questions, answered.

Does the $15,000 figure prove the case was dismissed?

No. The excerpt shows terms, not a verified dismissal or completed payment history.

Can I calculate the monthly installment from this image?

No. The installment amount and starting date are redacted. Obtain the complete schedule.

Is CPLR 3215(i) itself a judgment against me?

No. It is a procedural provision. The actual stipulation, alleged noncompliance, application and court record require review.

Does signing a settlement extend my current court deadline?

Do not assume so. Confirm any extension, adjournment or other change with counsel.
