CFG Merchant Solutions Lawsuit or MCA Payment Problems?

Business Debt Law Group / MCA funder guide

When CFG payments become difficult, the first useful question is what the records show. Your agreement, bank statements, payment ledger and any default notice can help an attorney separate the amount claimed from the payments and charges that need review. You can request a free MCA review before a lawsuit is filed.

The CFG file

A CFG Merchant Solutions lawsuit or collection demand can raise several separate questions: what was advanced, what was collected, what conduct is alleged to be a default, and how the remaining balance was calculated. Treating those questions as a single number can hide the records an attorney needs to review.

In CFG Merchant Solutions, LLC v. Complete Automotive Repair Service, LLC, a November 2024 New York decision denied CFG’s summary-judgment motion because the submitted records did not establish its entitlement to judgment. The court discussed the foundation for business records and inconsistencies in transaction codes. That was a decision on that motion—not a ruling that every CFG agreement is invalid or that every merchant has the same defense.

For your matter, compare the signed agreement and any guarantee with the funding record, bank debits, payment ledger, reconciliation communications and itemized demand. Preserve the original statements, not only a spreadsheet you have prepared from them.

Follow the payment records, not just the demand.

Separate the original advance, payments and default charges.

A bank statement records money entering and leaving an account. A funder’s ledger may also include returned transactions, credits, default charges or other adjustments. An entry on one record does not necessarily explain an entry on the other. List any discrepancy by date and amount so it can be reviewed against the original records.

If daily withdrawals have become difficult, preserve any request for reconciliation or a payment adjustment and the response you received. If a lawsuit has already been filed, the complaint, exhibits and service information need a separate review. A negotiation about the balance does not by itself extend the time to respond in court.

Before the next call or deadline

Four practical first steps.

  1. Check for a court deadline. If you received court papers, identify where the case is filed and when a response is due. Settlement discussions do not automatically extend a deadline.
  2. Put the records in one place.Collect the agreement, payment history, bank statements, and every notice. Preserve emails and texts, including any proposed settlement terms.
  3. Review a proposed change before signing.A new agreement, acknowledgment, release, or guarantee can affect your rights and obligations. Have its terms reviewed in context.
  4. Discuss a plan for your actual situation.Ask which legal or negotiation options fit the documents, cash flow, and litigation status—and what representation would cost.
Questions about this funder

CFG MCA questions, answered.

My statement says CFG Merchant Sol ACHPAYMENT. What should I gather?

Bring the complete bank statement, the agreement, any merchant-portal payment history and the notice demanding payment. Include returned transactions and later corrections. A transaction description alone does not identify every term of the contract or explain the claimed balance.

What if CFG’s demand includes default fees?

Ask for an itemized calculation and have the contractual basis, payment history and applicable law reviewed. The presence of a fee in a demand does not resolve whether it is recoverable in your matter.

Does the Complete Automotive decision mean my CFG contract is unenforceable?

No. The cited decision addressed the evidence supporting a particular summary-judgment motion. Your agreement, records, court and case history may differ. It should not be used as a reason to ignore a summons or stop responding.

Can a CFG judgment still be discussed in settlement?

A negotiated resolution may be possible after judgment, but the judgment and any enforcement activity must be addressed in the actual terms. The example above does not establish completed payments, a satisfaction of judgment or a release in another matter.
