The Fenix file
Fenix’s own product page describes merchant cash advances and an MCA consolidation program. A new financing arrangement and a negotiated resolution of an existing obligation are different transactions. Business Debt Law Group provides legal representation in MCA matters; it does not provide or arrange Fenix financing.
The Fenix correspondence in BDLG’s published library offers a concrete reason to read beyond the headline number. It sets installment terms but also says the letter does not affect pending litigation or other collection activity initiated before signing. Those issues require attention even if a monthly payment looks manageable.
When reviewing your Fenix account, bring the original MCA, any later renewal or consolidation documents and all pending court papers. The current claimed balance may need to be reconciled against more than one funding or payment event.

Fenix installment terms: read the next paragraph, too.
The redacted letter states $40,000 in settlement terms against a $91,906.02 balance, with an initial installment and later monthly payments. It ties closing the account to performance, describes consequences if payment is late, and says the letter does not affect litigation or collection activity already initiated. Payment completion is not established by this excerpt.

Partial, redacted excerpt from one matter. Other pages, amendments and later events may affect these terms. This discussion does not summarize the complete agreement or case. Acceptance, completed payment, releases and the final outcome require verification from the complete records. This is not a standard offer or promised result. Past results do not guarantee a similar outcome.
Check what a Fenix agreement leaves unresolved.
Before accepting an installment proposal, ask whether litigation continues while payments are made and whether a separate filing or agreement is needed to address it. Identify any guarantee, MCA UCC filing or third-party collection notice that the proposal does not expressly resolve. An account settlement and a court disposition are not interchangeable documents.
Review the required payment date and delivery method alongside your cash-flow projections. The example contains consequences tied to late payment; your terms may differ. Preserve proof of each payment and any written extension rather than relying on an informal telephone assurance.
Where does your Fenix matter stand?
MCA payments are too much
Review receipts, overlapping advances and any reconciliation request before committing to another arrangement.
Receivables or accounts are affected
Bring the actual MCA UCC, customer, processor or bank notice so the source and scope of the restriction can be assessed.
Court papers have arrived
Identify the court, parties, service details and response requirements promptly. Negotiations do not automatically extend a deadline.
Four practical first steps.
- Check for a court deadline. If you received court papers, identify where the case is filed and when a response is due. Settlement discussions do not automatically extend a deadline.
- Put the records in one place.Collect the agreement, payment history, bank statements, and every notice. Preserve emails and texts, including any proposed settlement terms.
- Review a proposed change before signing.A new agreement, acknowledgment, release, or guarantee can affect your rights and obligations. Have its terms reviewed in context.
- Discuss a plan for your actual situation.Ask which legal or negotiation options fit the documents, cash flow, and litigation status—and what representation would cost.
Fenix MCA questions, answered.
Is a Fenix consolidation offer the same as debt settlement?
No. A financing proposal may create new obligations. Settlement concerns the terms on which an existing obligation may be resolved. Compare the complete documents and total payments, not just the immediate daily or monthly amount.
Does signing the letter shown above stop a lawsuit?
The excerpt expressly says it does not affect pending litigation or other collection activity initiated before signing. The court case and any separate agreement to address it would need review. Do not assume your response deadline has changed.
What happens if a Fenix installment is late?
The example describes termination of its settlement terms and the original balance becoming due if payment is not received on time. That is a condition of this document, not a universal statement about every Fenix agreement. Have your own default and notice provisions reviewed.
Can I request help while payments are still current?
Yes. A free MCA review can examine the current agreement, other advances and expected receipts before a missed payment. Any retained legal-service fees are separate and addressed in engagement terms.
What does the free MCA review cover?
The initial consultation can address your MCA agreement, payment pressure, collection communications or case status. Consultations are free. Any retained legal-service fees are separate and addressed in the engagement terms.
