Five Tower MCA collection letter or lawsuit concerns?

Business Debt Law Group / MCA funder guide

When a letter says a funder has authorized someone else to accept payment, verify both the authority and the account being resolved. A short collection letter can leave important questions outside the visible page.

The Five Tower file

BDLG’s published letter names Five Tower, LLC and lists a referred balance and a present balance. It says Five Tower authorized the sender to accept specified settlement payments. The sender’s identifying information is redacted in the public copy.

That is evidence of what the letter says, not proof of a particular collection agency’s identity or authority in your matter. Match the account, sender and payment instructions against your agreement and other correspondence before sending money or signing an acknowledgment.

The excerpt does not show a complaint, judgment or complete case history. A collection letter should not be described as proof that a lawsuit was filed. If you have separate court papers, they need their own deadline and docket review.

Three ACH installments subject to receipt conditions

Stated balance $16,764.88 / settlement terms $7,500

The letter lists both a referred balance and a present balance of $16,764.88. It describes $7,500 in three monthly installments of $2,500 through preauthorized ACH, with satisfaction conditioned on payment. It also requires signed acceptance and says the settlement is void if funds are not received as outlined. Dates and identifying details are redacted, so the excerpt does not establish acceptance or performance.

Partial, redacted excerpt from one matter. Other pages, amendments and later events may affect these terms. This discussion does not summarize the complete agreement or case. Acceptance, completed payment, releases and the final outcome require verification from the complete records. This is not a standard offer or promised result. Past results do not guarantee a similar outcome.

Collection authority / Account scope

Confirm who can bind the funder and what the payment resolves

Preserve the full letter, envelope or email headers and earlier communications. Confirm the sender’s relationship to the named funder and authority to approve the proposed resolution through a verified contact channel. A familiar logo or forwarded payment instruction is not enough to resolve conflicting information.

Read the account reference and satisfaction language together. If you have several advances, a renewal, a guaranty or a separate judgment, ask which obligations are covered and which documents will confirm closure. Do not assume a letter resolving one referred account also resolves another account or every enforcement issue.

An ACH authorization and an actual cleared payment are different records. Confirm when funds must be received, how a returned debit would be handled and whether any cure provision exists in the complete terms. Keep confirmations and a final accounting; the short public example does not show every possible closing requirement.

Before the next call or deadline

Four practical first steps.

  1. Check for a court deadline. If you received court papers, identify where the case is filed and when a response is due. Settlement discussions do not automatically extend a deadline.
  2. Put the records in one place.Collect the agreement, payment history, bank statements, and every notice. Preserve emails and texts, including any proposed settlement terms.
  3. Review a proposed change before signing.A new agreement, acknowledgment, release, or guarantee can affect your rights and obligations. Have its terms reviewed in context.
  4. Discuss a plan for your actual situation.Ask which legal or negotiation options fit the documents, cash flow, and litigation status—and what representation would cost.
Questions about this funder

Five Tower MCA questions, answered.

Does this letter establish that Five Tower sued the merchant?

No. The visible letter does not establish the case history. Court papers and the docket would answer that question.

Why check the sender if Five Tower is named?

The sender’s identity is redacted in the public copy. In your matter, confirm who is authorized to accept payment and bind the account holder.

Does authorizing ACH prove the account was paid?

No. Authorization, successful collection and satisfaction of the agreed conditions are separate events.

Is $7,500 a current offer available to other merchants?

No. These were terms described for one identified account with its own conditions and dates.

What does the free MCA review cover?
