Heavenly Funding MCA lawsuit or a settlement stipulation to review?

Business Debt Law Group / MCA funder guide

A monthly settlement figure is only part of a court agreement. Our attorneys review the payment plan together with the acknowledgments, deadlines and default provisions you may be asked to accept.

The Heavenly file

Heavenly Funding’s website lists merchant cash advances among its services. The document in BDLG’s public library names Heavenly Funding LLC as plaintiff and describes unpaid receivables plus certain fees. Our guide concerns MCA obligations; the business’s actual contract determines which product and legal parties are involved.

The displayed page is headed as a settlement stipulation with leave to apply for default judgment under New York CPLR 3215(i). It also includes consent to the court’s jurisdiction and acknowledgment of service. Those provisions make the court posture an important part of evaluating the proposed payment relief.

The example is not evidence that every Heavenly matter uses the same document or court. A business outside New York should still check the court named in its papers and the terms actually presented to it.

$124,398.75 stated balance / $68,328 conditional settlement

The excerpt states indebtedness of $124,398.75 and provides for acceptance of $68,328 if the agreement is not breached. It lists $3,796 monthly wire payments, with dates redacted. This is only the displayed portion of the stipulation; the complete schedule, remaining terms and later events are needed to determine the matter’s actual status.

Acceptance, completed payment, releases and the final outcome require verification from the complete records. This is not a standard offer or promised result. Read the court agreement alongside the cash plan

Review what you are agreeing to, as well as what you will pay.

Treat the consent to jurisdiction and acknowledgment of service as substantive terms. Bring the complaint, how it was delivered and any prior response to the attorney reviewing the stipulation. Ask how signing affects issues that may still be available in your particular case.

CPLR 3215(i) addresses qualifying settlements made after an action begins that authorize entry of judgment without further notice upon noncompliance. Its requirements and the complete stipulation need review. The heading on this excerpt does not tell us the full default mechanism or show that a judgment was entered.

Build a dated payment calendar from the entire agreement, rather than dividing the displayed total by the monthly figure. Confirm the first due date, when each wire must arrive, how payments are credited, any final-payment provision and what happens if a transfer is delayed. Preserve amendments or extensions in the same file.

Compare the proposed obligations with expected business receipts and all other MCA withdrawals. If the plan appears unaffordable, raise that before signing. Ask counsel to identify the terms governing notice, opportunities to cure, any amount claimed after default and the conditions for closing the case. Those answers cannot be supplied by the first page alone.

Before the next call or deadline

Four practical first steps.

  1. Check for a court deadline. If you received court papers, identify where the case is filed and when a response is due. Settlement discussions do not automatically extend a deadline.
  2. Put the records in one place.Collect the agreement, payment history, bank statements, and every notice. Preserve emails and texts, including any proposed settlement terms.
  3. Review a proposed change before signing.A new agreement, acknowledgment, release, or guarantee can affect your rights and obligations. Have its terms reviewed in context.
  4. Discuss a plan for your actual situation.Ask which legal or negotiation options fit the documents, cash flow, and litigation status—and what representation would cost.
Questions about this funder

Heavenly MCA questions, answered.

Why does a payment agreement mention jurisdiction and service?

A stipulation in an existing case can include court-related acknowledgments as well as payment terms. Have counsel explain those provisions and their effect on your own case before signing.

Does the CPLR 3215(i) heading mean a judgment already exists?

No. A reference to a procedure does not establish that it has been used. Review the complete stipulation, the docket and any actual judgment or order.

Can I work out all payment dates from the amount shown here?

No. The dates are redacted and other pages or amendments may matter. Use the operative agreement and ledger to confirm the schedule, credits and final payment.

Can BDLG help before Heavenly files a lawsuit?

Yes. You can request a free MCA review while payments are becoming difficult, even if no lawsuit has been filed. Available options depend on the agreement, records and circumstances.

What does the free MCA review cover?

The initial consultation can address your MCA agreement, payment pressure, collection communications or case status. Consultations are free. Any retained legal-service fees are separate and addressed in the engagement terms.
