Highland Hill Capital Lawsuit or disputed MCA balance?

Business Debt Law Group / Funder guide

Whether an agreement was breached and how much is owed can be separate issues. A Highland Hill review should follow both the funding history and the calculation behind the present demand.

The Highland Hill file

In Highland Hill Capital, LLC v. Rip's Venice Sports Bar & Billiards, LLC (2025), a New York trial court found the particular agreement was an MCA and granted the funder summary judgment on liability. It did not award the requested damages at that stage because the calculation had not been clearly established; damages and attorney's fees were left for trial.

The decision described funding delivered through multiple weekly deposits. It illustrates why the disbursement history, remittances and additional charges should be reconciled separately. It is a public decision, not a BDLG result, and does not establish what happened in a different Highland Hill account.

Your contract / Your records

Rebuild the balance from transactions you can document.

List each funding deposit

Record the date, gross amount, deductions and net deposit for each disbursement. Match each transaction to the relevant agreement or schedule instead of assuming all deposits concern the same obligation.

Account for credits

List successful withdrawals, wires, reversals and refunds. Compare the funder's ledger with the bank records and flag specific mismatches without treating a disputed item as an established error.

Separate additional charges

Identify default charges, returned-payment fees, filing expenses and requested attorney's fees separately from the remaining purchased amount. Ask which provision and record supports each component.

The details that change the review

Understand what a court order actually decided.

Bring the signed order and any judgment, not just a docket description. An order addressing liability, an unresolved amount and an entered money judgment are not the same procedural event. Counsel can explain what remains to be addressed in your matter.

Include records of reconciliation requests and claimed contract breaches alongside the accounting. A balance review does not replace analysis of the agreement, the guarantee or the underlying allegations.

For settlement discussions, request a written total and allocation of payments. The documents should explain which claims are resolved, what remains due if performance fails, and how existing orders, liens or collection notices are treated.

Before the next call or deadline

Four practical first steps.

  1. Check for a court deadline. If you received court papers, identify where the case is filed and when a response is due. Settlement discussions do not automatically extend a deadline.
  2. Put the records in one place.Collect the agreement, payment history, bank statements, and every notice. Preserve emails and texts, including any proposed settlement terms.
  3. Review a proposed change before signing.A new agreement, acknowledgment, release, or guarantee can affect your rights and obligations. Have its terms reviewed in context.
  4. Discuss a plan for your actual situation.Ask which legal or negotiation options fit the documents, cash flow, and litigation status—and what representation would cost.
Questions about this funder

Highland Hill questions, answered.

Did the cited case erase the merchant's obligation?

No. The funder won on liability. The court required further determination of damages and attorney's fees.

Why review several funding deposits?

A transaction history can clarify the money delivered, deductions and payment credits. It helps counsel evaluate the actual balance rather than a single summary number.

Does disputing the balance answer every claim?

No. The amount, contract terms, alleged breach and personal guarantee can require separate analysis.

Must a lawsuit already exist to request help?

No. BDLG can review payment pressure or a demand before litigation, as well as papers from an existing case.

What does the free case review cover?

The initial consultation can address your funding agreement, payment pressure, collection communications or case status. Any retained legal-service fees are separate and addressed in the engagement terms.
