The LG Funding file
In LG Funding, LLC v. United Senior Properties of Olathe, LLC (2020), New York's Appellate Division upheld the denial of the funder's summary-judgment request because factual issues remained about the particular transaction's classification. The opinion examined discretionary reconciliation language and provisions addressing bankruptcy and payment obligations.
The court allowed the challenged affirmative defenses to remain at that stage while directing dismissal of the criminal-usury counterclaim. This mixed procedural result was not a final declaration that all LG Funding agreements are unlawful. The cited litigation is not presented as a BDLG result.

Locate the adjustment provision
Give counsel the full reconciliation clause and any related addendum. Preserve the requests and responses showing what happened when the business sought a different remittance.
Identify the alleged default
Keep the demand or complaint and mark the conduct it alleges. Falling sales, a payment calculation dispute and a claimed breach of another contract provision may raise different questions.
Bring evidence supporting the dispute
Statements, revenue reports, written communications and transaction records give the attorney facts to compare with the claim. A citation to another company's litigation cannot supply missing evidence from your account.
A defense and a claim for money are different requests.
During a review, distinguish your immediate objective: responding to a complaint, disputing the balance, seeking revised terms or evaluating a possible claim. Counsel should assess each objective under the governing agreement and law rather than treating them as interchangeable.
Keep a separate list of the business's obligations and any personal guarantee. Identify who signed in each capacity and whether a later document expressly changed those commitments. Provide any court order already entered so the review starts from the case's current stage.
If the parties discuss a settlement, evaluate the payment schedule alongside releases, judgment provisions and lien-related obligations. A negotiated amount alone does not establish that all litigation or collection activity will end.
Four practical first steps.
- Check for a court deadline. If you received court papers, identify where the case is filed and when a response is due. Settlement discussions do not automatically extend a deadline.
- Put the records in one place.Collect the agreement, payment history, bank statements, and every notice. Preserve emails and texts, including any proposed settlement terms.
- Review a proposed change before signing.A new agreement, acknowledgment, release, or guarantee can affect your rights and obligations. Have its terms reviewed in context.
- Discuss a plan for your actual situation.Ask which legal or negotiation options fit the documents, cash flow, and litigation status—and what representation would cost.
LG Funding questions, answered.
Does the LG Funding case cancel my agreement?
No. It addressed particular language and evidence at a particular procedural stage. Your contract and current case record require their own review.
Is LG Funding the same as LCF Group?
Do not assume so from the initials. Match the exact legal name in your agreement, notices and court caption.
Should I rely on the funder's name to identify a defense?
No. Counsel needs the executed terms, performance record and allegations in your matter. A brand name alone is not enough.
Can I request help before being sued?
Yes. Payment pressure, an adjustment dispute or a proposed resolution can be reviewed before court proceedings begin.
What does the free case review cover?
The initial consultation can address your funding agreement, payment pressure, collection communications or case status. Any retained legal-service fees are separate and addressed in the engagement terms.
