Mulligan Funding Lawsuit or business-funding payment problems?

Business Debt Law Group / Funder guide

The date and originator of a Mulligan account can change the starting point for legal review. An older MCA and a bank-issued business loan should not be analyzed as if they were the same product.

Free initial case review.
No lawsuit is required to ask for help.

The Mulligan file

Mulligan Funding's current advertising disclosures say the majority of its business loans are issued by FinWise Bank. Its historical product notice states that before January 23, 2020, Mulligan originated its own loans and merchant cash advance contracts, with most later funding offered through a FinWise loan program.

These disclosures explain why a search for Mulligan Funding may turn up both MCA and loan language. They do not identify the product, current owner or terms of your particular account. Use the executed agreement, renewals and servicing records to establish those facts.

Your contract / Your records

Build a record that follows the account through renewals.

Start with the original contract

Locate the signature pages, product description, repayment provisions and named originator. A bank debit containing a familiar brand name may not identify every party to the transaction.

Add each renewal or additional draw

Keep each later agreement, disbursement record and payoff statement. Record whether an earlier obligation was satisfied, refinanced or left outstanding; the current demand should be compared with that history.

Identify who is asking for payment now

Collect servicing and assignment notices together with the demand letter or complaint. Ask for a clear explanation of the claimed balance and the capacity in which each company is acting.

The details that change the review

A legacy MCA search should not obscure the actual loan terms.

If the agreement is a loan, bring its note, amortization or payment schedule, security documents and any modification. If it is a receivables purchase, bring the remittance and reconciliation provisions along with the business's revenue records. The document review should follow the product actually used.

When several funding obligations overlap, prepare a list of all withdrawals and their recipients. This helps separate the Mulligan account from unrelated MCAs and avoids attributing another funder's payment or collection action to it.

For a proposed resolution, request written terms identifying the covered account, payment schedule, release conditions and treatment of any guarantee or lien. Existing court papers require their own review; discussions about a payment plan are not proof that a case has ended.

Before the next call or deadline

Four practical first steps.

  1. Check for a court deadline. If you received court papers, identify where the case is filed and when a response is due. Settlement discussions do not automatically extend a deadline.
  2. Put the records in one place.Collect the agreement, payment history, bank statements, and every notice. Preserve emails and texts, including any proposed settlement terms.
  3. Review a proposed change before signing.A new agreement, acknowledgment, release, or guarantee can affect your rights and obligations. Have its terms reviewed in context.
  4. Discuss a plan for your actual situation.Ask which legal or negotiation options fit the documents, cash flow, and litigation status—and what representation would cost.
Questions about this funder

Mulligan questions, answered.

Is Mulligan Funding only an MCA provider?

No. Current and historical disclosures describe different products. In particular, the current disclosures identify FinWise Bank as issuing the majority of business loans.

Why does the contract name a bank?

The company through which funding was arranged and the loan's originator can differ. Your agreement and servicing notices should identify the roles.

Does an old article describe my current agreement?

Not necessarily. Check the date and product on your executed documents rather than applying an older marketing description to a newer transaction.

Can BDLG review a loan dispute as well as an MCA matter?

A case review can identify the product and legal issues, including how business-loan obligations interact with other MCA payment pressure. Representation depends on the matter.

What does the free case review cover?

The initial consultation can address your funding agreement, payment pressure, collection communications or case status. Any retained legal-service fees are separate and addressed in the engagement terms.
