The Simply file

The Simply Funding, LLC stipulation in BDLG’s published library separates the damages sought in the action from additional interest, costs and attorney fees. It then states a settlement amount and permitted payment methods. That combination makes it especially useful for understanding what a simple savings comparison can leave out.

For your own matter, identify whether the number in a collection email is unpaid receivables, an amount claimed in court or a proposed payoff. Ask what date the calculation applies to and what charges are included. Do not assume two figures are directly comparable because they appear in the same letter.

If business revenue has fallen, include prior requests for reconciliation and any supporting records. If litigation has begun, include the pleadings and response history as well. A settlement discussion should be evaluated in the context of the actual claim and the business’s ability to perform.

Documented terms: $10,000 · comparison amount: $11,917.07

The excerpt describes an action seeking $11,917.07 plus additional interest, costs and attorney fees, and states $10,000 in settlement terms. It specifies permitted payment methods and emphasizes timely payment. The $11,917.07 figure therefore excludes the additional items described in the document. Payment completion is not established by this excerpt.

Compare what is included, not just the two numbers.

Make the proposed payoff understandable before you accept it.

Write down the stated total, which charges it includes, when it expires and how payment must be delivered. If the instructions require cleared or received funds by a deadline, ask how processing time is handled. Preserve the instructions and obtain confirmation of any change in writing through verified contact channels.

Also identify what happens after performance: whether a pending action will be addressed, whether a guarantor is included and what confirmation of resolution will be provided. A payment receipt, settlement agreement and court dismissal establish different things. An attorney can review how those pieces fit your matter.

Before the next call or deadline

Four practical first steps.

  1. Check for a court deadline. If you received court papers, identify where the case is filed and when a response is due. Settlement discussions do not automatically extend a deadline.
  2. Put the records in one place.Collect the agreement, payment history, bank statements, and every notice. Preserve emails and texts, including any proposed settlement terms.
  3. Review a proposed change before signing.A new agreement, acknowledgment, release, or guarantee can affect your rights and obligations. Have its terms reviewed in context.
  4. Discuss a plan for your actual situation.Ask which legal or negotiation options fit the documents, cash flow, and litigation status—and what representation would cost.
Questions about this funder

Simply MCA questions, answered.

Does the $11,917.07 example include every charge asserted?

No. The excerpt describes additional interest, costs and attorney fees separately. The comparison should retain that qualification and should not be described as the complete all-in claim.

Why does the method of payment matter?

The example specifies acceptable methods and emphasizes the payment deadline. Your own terms may condition the arrangement on how and when funds are received. Check the exact requirements before committing to a payment.

Can I still dispute a balance while exploring settlement?

An attorney can assess the records and the implications of proposed communications or acknowledgments. Negotiation and litigation strategy should be coordinated; do not assume a settlement conversation automatically preserves or waives every position.

Is a free review available before Simply files a lawsuit?

Yes. You can request help with an existing MCA while payments are current, strained or in collection. A lawsuit is not required. Legal-service fees for retained representation are separate from the initial free review.

What does the free MCA review cover?

The initial consultation can address your MCA agreement, payment pressure, collection communications or case status. Consultations are free. Any retained legal-service fees are separate and addressed in the engagement terms.
